Section 138 of Negotiable Instrument Act 1881
Dear Sir/Madam,
Under the instruction and authority from my client Mr. A( here referred to as my ‘client’), I do hereby serve upon you the following notice of demand under Section 138 of the Negotiable Instrument Act, 1881:
1. On _____(date) my client and yourself have entered into an agreement of ( ___).
2. The ________(goods or services) were delivered on ______(date) as agreed upon the agreement made.
3. A cheque _________(BEARING NUMBER) was issued on an amount of _______(Amount mentioned in cheque) against the agreement for (____) by you on _______(ISSUE DATE) to present before the _________(BANK DETAILS) on _________(PRESENTING DATE).
4. Due to ___________(insufficient fund/wrong signatures/mismatch of figures) the cheque got dishonoured on the date it was presented by the above-mentioned client at the _________(details of a bank).
5. The drawee bank intimated the client that the cheque got dishonoured by making an endorsement____________( fund not sufficient/ wrong signature/mismatch of figures) vide ________[Returning Memo No. ] on ___________[Cheque Return Date].
6. Under this circumstance, we request you to pay the due amount which is ________(Amount mentioned in cheque) to the client within 15 days of receipt of this notice failing which our client shall take legal action you.
A copy of this Notice is kept in my office for record and further necessary action and you are also advised to keep the copy safe as you would be asked to produce in the court.
